Ethan, thank you so much for this article! I think about this all the time. All those years ppl fought to limit $ in politics so that by the time I was cutting my career teeth we could actually hold politicians accountable for what they promised, how they voted and what they said. SCOTUS & Citizens United stole that from the ppl. Another keystone was when they gave corporations personhood, which together with Citizens forms the root of the problem in politics today.

Once I was appalled that they turned corporations into persons, then I learned that the real crime was turning people into corporations. This was started with the 14th amendment and the definition of a US citizen as a subject of the United States.

So tell me how would you kill Citizens United? State by state as I have read or something else? Let’s get it put to a vote! I have been waiting ever since the Supreme Court’s said a Nazi Organization had the same rights as a 72 year old man. But not a woman who took her husband last name when she was 18.

Hey Terry,

Thanks for reading and engaging. And yeah, that feeling of "We are screwed" when you stare Citizens United in the face? Totally understandable. It was a gut punch to democracy, designed to make us feel powerless.

You asked how we fight it. The hard truth is, waiting for the current Supreme Court (the same one making rulings like the one you mentioned) to overturn it directly feels like waiting for rain in a desert. A national vote isn't really on the table constitutionally for a court decision either.

But that doesn't mean we're powerless. The path forward, the one outlined in the "Counter-Narrative" section of the article, is asymmetrical. We can't outspend them dollar-for-dollar, so we change the battlefield:

State and Local Action: This is key. Cities like Seattle and states like Minnesota are already passing laws to ban political spending by corporations with significant foreign ownership, finding creative legal ways around the ruling. We build firewalls city by city, state by state.

Public Financing & Small Donors: NYC's matching system proves we can amplify the power of ordinary people's contributions to compete with oligarchs. The surge in small-dollar donors nationally shows this is already happening. We build our own funding engine, fueled by the many, not the few.

Build the Alternative: Ultimately, we make Citizens United irrelevant by building a powerful, connected Phalanx and a Common-Wealth that operates on our values (like The Rebel's Contract), not theirs. We build the systems they can't buy.

It's not easy, and it's not fast. It requires exactly the kind of frustration and righteous anger you're feeling, channeled into disciplined, local, creative action. We don't wait for one big federal fix; we start building the Constructed Miracle right where we stand. Keep that fire lit, Terry. That's the fuel.

Harvard Law wrote about how a bipartisan team of former Montana officials have drafted a constitutional initiative headed toward the Montana 2026 ballot that will counter Citizens United in Montana. It is based on the fact that every state has the authority to define the powers it grants its corporations. The initiative seeks to ban Montana corporations - and any corporations that do business with them - from pouring money into Montana politics. It is an unexplored governmental power that resides in the States and has not been explored. It is a tantalizing prospect as far as I am concerned and has enormous implications and applications.

That sounds like another States Rights battle when corporations challenge the Montana State govt? Surely the make up of the Supreme Court will have to change?

This should be introduced in every state! But Democrats would need to take at least 51% of the state offices and a Democrat Governor. States like mine it would never see the light of day. Mo citizens voted in sick day allowances from work. The Repugs over road the voice of the people. Funny the house and senate office holders get sick days.

I'm sorry you live under those conditions. I am in a mostly blue state with a dem gov and 2 dem senators but a bright red county. I know this initiative might not fly in every state and it might not fly in Montana since its so red but lets see what happens when it gets going. I just feel like we have to do SOMETHING in the offense. I get so sick and tired of feeling like we have no options.

I’m sure that’s correct unfortunately. However if Montana can do this so can CA and other solidly “blue” States with Democratic Governors. Then you collectively have to deal with the Supreme Court and that needs a large Dem. majority in both houses.

Can’t believe you don’t have sick days in permanent employment! Maybe starvation will turn your State at least “purple?”🌺

California is unlikely to do this. That state, along with Texas, has had every election bought and paid for by powerful interests more than others. The amount of corporate money that was dumped into some of the more influential elections recently is staggering.

You have spoken well & true.

I listened to justice kennedy a few nights ago & he still appeared to have missed the magnitude of evil possibility. Could he be nearly oblivious to the state we’re in? He seemed to suggest that the outcome was intended, that we do exactly as you are persuading us to do. It’s just difficult to watch him & believe that he could have thought all that?

Nevertheless, here we are & i am persuaded. I just cant get past the idea of so much time & effort given to begging, when at least 1 thing might help… GET ALL THE MONEY OUT OF ELECTIONS! It makes sense to me, every time i pick up my phone, every morning, its on fire! -with 30 ppl, trying every conceivable way of getting a $ out of me when i dont have it! Yes, maybe i have $1 today -out of 2tiny SS checks (for which i am very grateful), but that dollar multiplies with every new message, every day. AND, look at the time it takes to find & put out another clever poll, or survey with the most insultingly stupid questions… I’m screaming & thankful for a direct ask! How many advisors does the party pay for this shlok & then demand every candidate follow the plan? But, i digress. Not only will the candidates be begging to get elected this time, but when there are serious issues to attend, they will be asking for next year. Could we GET ALL THE MONEY OUT OF ELECTIONS? Find out WHO is smarter, using the same amount of time? I know this gets down to the grit on my kitchen floor, but it’s real. I just wonder if getting the money out of elections will help us get there. And, i know we can do it. Do you agree? We are in this together & i am WAY ready for what works because time is very precious…

Michele and Nancy, thank you both for these powerful comments. You've hit the nail on the head.

Michele, your frustration with the sheer effort needed to fight their mountain of money with grassroots pennies is exactly the point. It feels impossible because, frankly, trying to beat them solely at their game often is. That exhaustion you feel is real, and it's by design. And yes, the ultimate goal involves breaking the chokehold money has on our system.

Nancy, you nailed the critical obstacle: why would those benefiting ever willingly level the playing field? They won't. Waiting for them to reform themselves is like waiting for the Rust to cure itself.

That's why our approach has to be different. It's not just about trying to force the money out of their broken system through traditional means (though efforts like public financing are valuable!). It's about making their money less relevant by building our own power structure outside their control.

How?

Forge the Phalanx 🔱: We build a high-trust community that operates on different values.

The Engine Protocol ⚙️: We focus on tangible, local action – supporting local producers, building alternative networks – creating real-world power that can't be easily bought or sold by D.C. lobbyists.

The Rebel's Contract: We create our own transparent funding model, directly empowering the fight instead of feeding their system.

It's asymmetrical warfare. We don't need to match their billions if we build a resilient, independent, and coherent force that simply doesn't play by their corrupt rules. Getting the money out is part of it, but building the Common-Wealth of Producers where our values rule is the ultimate checkmate.

Michele, you're right, time is precious. And yes, we are absolutely in this together. Let's focus that readiness on building the alternative. That's the work that truly changes the game.

Michele, that "I'm in" is music to my ears! That's the energy that builds miracles. Welcome to the Forge! 🔥

You asked for Step 1, and it's beautifully simple, but it requires a crucial mental shift away from their game:

Step 1 is Joining the Phalanx & Starting Your Local Map.

Join the Forge (Our Community): The real work happens when we connect and build together. Are you on our Discord ("The Rebuttal") or primarily engaging here on Substack? Getting plugged into the War Council, sharing intel, and learning from others is the first concrete action. That's where we Forge the Phalanx 🔱.

Start Your Local Map (Engine Protocol ⚙️): Begin observing your immediate community through our lens. Instead of focusing energy on national politics or begging candidates, start identifying:

Who are the local producers, small businesses, farmers, artists, and creators in your town?

Who are the local "Rust" agents – the predatory landlords, the corporate chains hollowing out Main Street, the complicit local officials?

What are the local pain points caused by the system (food deserts, lack of good jobs, crumbling infrastructure)?

This isn't about running for office (yet!); it's about mapping the territory for our own alternative system – The Common-Wealth. That's the "mainstage" work that makes their money less relevant over time.

Your incredible energy isn't meant to be wasted begging pennies for their broken system. It's meant to build ours. Let's do it together.

Let’s also focus on state legislatures as they are the source of corporate rights. Robert’s refers to the state charters as the source of corporate rights and it is legislatures who determine those rights, not the constitution. States now five corps all the rights of people and that can be removed. Only of course, if legislators are pressured to do so.

Giving corporations the same status and rights of a human citizen has more far reaching harm than a quick glance may reveal. Upon deeper reflection, one may discern the sickening loss of freedom of religion. People have forgotten our history. I can't believe anyone would want to destroy the separation of Church and State. Have we forgotten all that history has taught us? ... even as recently as 500 years ago?

The ideas that corporations are people and money is free speech were have allowed the nineteenth century robber barons to ride free again. I’m glad you have a plan to help citizens take back power.

I’m not a resident or citizen of the USA but here from Australia I see the investment power of transnational corporations and the constant, and to some extent successful, attempts by Federal and State governments to negotiate boundaries and set investment controls, for instance where projects conflict with mining rights, water allocation, indigenous land rights, environmental laws, bio security laws, banking laws, land ownership and even social policies on housing and pharmaceutical benefits. Investment by foreign entities in utilities and transport infrastructure is imo a weak spot while joint military co operation with foreign powers (especially the USA) needs careful governance.

Internally laws limit spending on our electoral candidates are strict but billionaires with international corporate interests can still influence public opinion significantly through creating sham parties to divert votes and by purchasing advertising, and of course through ownership of much of the media. (eg Murdoch press)

Best wishes with your work. A democratic USA is needed for your own citizens wellbeing at home and also so that you can play your part in trade, humanitarian and cultural exchange and development world wide. This also reflects back into domestic well being as this year’s tariffs and the re direction of numerous countries trade away from the US has shown.

Robber barons are not useful anywhere. 💚🌺🇳🇿

Let’s get this straight, you believe we—those who are against the oligarchs—can beat the facist elected in 2024 and the corrupt few oligarchy who have us by the gonads—can beat them if we just fund small community organizing programs. Do you realize how many emails and texts I get a day from the news media, potential Democrats running for office, the DNC federal, state and local offices, etc asking money? Don’t you realize the bulk of democratic voters are at or below the poverty line. You may think $5.00 isn’t that much, but for me it’s a dozen eggs and a loaf of bread—breakfast for 6 days. Are you even going to acknowledge to me that money is an issue. I go to rallies, I vote early so I can drive folks to the polls so they can vote, I write my 3 representatives daily, call them 3 to 4 times a week, I do phone calls, knock on doors. We, the people, are doing our best, but we just can’t even match one of the oligarch’s war chest. In Tennessee we’re doing our best to send just 1 more democratic in a special election to

Mary, I am genuinely moved by your commitment. Driving voters, making calls week after week – that's incredible dedication, especially when facing financial hardship yourself. Your frustration is completely valid; the system is drowning in oligarch money, making grassroots efforts feel impossible.

You wished for a "creative out of the box" leader, but what if the creativity needs to come from us, the people, building something new outside that broken system? What if we could build a community and a strategy (The Rebuttal) where your incredible energy isn't just spent trying to win one more seat in their rigged game, but is invested in building a whole new system that actually serves us?
