If you listen to the Administrative Elite, you would think the biggest threat to humanity is an open-source AI generating a deepfake.
The Rust is currently marching through Washington D.C., demanding that the government lock down the foundational models of the future. The monopolies are begging for regulatory capture. They are insisting that the Cognitive Commons must be enclosed, gated, and controlled by the Rust—and only the Rust—for the sake of “Public Safety.”
It is a beautiful, terrifying PR campaign. It relies entirely on the public having zero memory of the last fifteen years.
If we are going to hand the keys of human cognitive infrastructure over to the Rust because they claim they are the only ones responsible enough to keep us “safe,” we should probably look at their actual safety record. We should probably do a lethal autopsy of the data dragnet they already built.
The Myth of the Rust’s Safety
The Rust did not industrialize human psychology to keep you safe. They industrialized it to build a vertical extraction engine.
When you look at the raw timeline of their data hoarding, you don’t see a history of protection; you see a history of catastrophic, negligent extraction. Look at the Equifax breach. Look at the 23andMe genetic data leaks. Look at the Facebook Cambridge Analytica scandal.
When the Rust hoards your data, they do not protect it. They extract it, they monetize it, and they inevitably leak it to the highest bidder. You are not a citizen to be protected; you are a product on a conveyor belt. They possess zero structural or moral authority to govern the safety of the next generation of computing, because they couldn’t even secure the last one.
But the incompetence is only the first layer. The true horror is the intent.
The In-Q-Tel Seed Capital: The Privatized Dragnet
The prevailing myth is that the “Attention Economy” was an accident. The public believes that companies like Google and Facebook just accidentally got really good at harvesting data because they wanted to sell you better shoe advertisements.
That is a lie.
The early infrastructure of the data economy didn’t emerge organically from a garage. It was seeded by the intelligence state. Specifically, it was seeded by In-Q-Tel, the venture capital arm of the CIA.
In-Q-Tel provided the foundational funding for Palantir Technologies. They provided the seed capital for Keyhole Inc. (which was acquired and rebranded as Google Earth). The intelligence community recognized very early on that the Fourth Amendment legally prevented the government from building a mass surveillance dragnet on American citizens.
But the Fourth Amendment doesn’t apply to private corporations.
The social media era was a public-private partnership. The intelligence state funded the architecture, and the Rust built the privatized panopticon. The “data broker loophole” allowed the government to simply purchase the surveillance data that the Rust extracted from you.
The data hoarding was never an accident. It was a weapon from Day One.
Your Phone is a Psychological Laboratory
They didn’t just passively collect that data. They weaponized it against you in real-time.
For the last decade, your phone has not been a communication device; it has been an unregulated psychological laboratory. The Rust has run continuous, massive A/B tests on the population to manipulate behavior, induce neurochemical addiction, and maximize engagement.
In 2014, Facebook published the results of their “Emotional Contagion” study. They admitted to intentionally filtering the News Feeds of nearly 700,000 users to see if they could alter their emotional states without their knowledge.
They succeeded.
In the medical and academic world, this is a severe violation of federal law. Under the Belmont Report and the Common Rule (45 CFR 46), any human-subject research requires explicit, unambiguous Informed Consent. You cannot conduct psychological experiments on human beings without an Institutional Review Board (IRB) and the explicit permission of the subject.
The Rust’s defense? They claim that because you clicked “I Agree” on a 10,000-word Terms of Service (EULA) when you downloaded the app, you consented.
This is intellectually and legally bankrupt. A coercive adhesion contract that forces you to surrender your rights just to participate in modern society fundamentally fails the standard of Informed Consent. This is unregulated mass psychological experimentation.
The Kill Shot: Piercing the Shield
For years, the Rust got away with this. Every time they were sued for behavioral manipulation, they hid behind Section 230 of the Communications Decency Act. They claimed they were just “neutral publishers” hosting third-party content, and therefore couldn’t be sued for how their algorithms sorted the feed.
But the armor is cracked.
In 2021, the Ninth Circuit handed down a ruling in Lemmon v. Snap, Inc. The court ruled that if an algorithm is intentionally designed to manipulate behavior or encourage dangerous actions (like the Snapchat Speed Filter), the platform is not a neutral publisher protected by Section 230.
It is a manufacturer of a defective and inherently dangerous product.
This is the behavioral strike. This is the class-action trap.
We don’t need new censorship laws to fight the AI monopolies. We don’t need a new federal agency to manage “AI Safety.” We just need a single, aggressive class-action legal firm to realize that the Rust is no longer protected by Section 230.
A Terms of Service agreement cannot legally indemnify a corporation from manufacturing a physically or psychologically dangerous product. The algorithms that induce learned helplessness and neurochemical addiction are not “services”—they are defective products.
The Rust is wide open for a massive class-action lawsuit for Negligent Algorithmic Design and unregulated human experimentation.
They built the prison. Now we use their own legal liability to tear it down.
